1. General

The following terms and conditions (“Terms”) govern the rules for participating in the “Friend3 Raffle and Trading Competition“ (“Promotion”) of WealthBizzTradeFX GmbH, with registered office in A-1020 Vienna, Stella-Klein-Löw-Weg 17 (“WealthBizzTradeFX”) and the resulting legal relationship between WealthBizzTradeFX and WealthBizzTradeFX Clients participating in the Promotion (“Participant” as defined in Section 3 or “you”).

By participating in the Promotion, you agree to these Terms and the applicable WealthBizzTradeFX Group TCs, WealthBizzTradeFX GmbH & BAM T&Cs, which form an integral part of these Terms. Please note that the English version is the authoritative version. By participating in the Promotion, you represent and warrant you meet the eligibility requirements below and acknowledge that failure to meet all eligibility requirements will result in your disqualification.

Investing in digital assets carries risks. In extreme cases, the invested amount may be lost completely. Conduct your own research before concluding a transaction. Section 24 of the WealthBizzTradeFX Group Terms apply. This Promotion does not constitute financial advice or an invitation to conclude a transaction. You should keep yourself informed and understand the risks involved in buying and holding digital assets.

2. Duration

This Promotion will begin on March 11th, 2024, 00:00 (CET) and end on March 17th, 2024, 23:59 (CET) (“Promotion Period”).

3. Eligibility and Entry:

Entry is open to fully verified and registered WealthBizzTradeFX Clients (“Participant”) who

(a) meet all the requirements described in these Terms,

(b) are not resident in a country or territory where the Promotion is not available*,

(d) accept these Terms.

New WealthBizzTradeFX users will be required to sign up and register, complete the identity verification process and deposit funds into a new WealthBizzTradeFX account in order to participate.

Natural or legal persons performing market-making services or any similar services as well as institutional customers are not eligible to enter the Promotion.

WealthBizzTradeFX Technology Solution users are not eligible to participate in the Promotion.

Employees and the immediate family members of such employees of WealthBizzTradeFX or its affiliated companies, parent companies, subsidiaries, participating promotional partners, advertising agencies, and any company involved in the creation, production, or fulfilment of the Promotion are also not eligible.

*Please note that - due to regulatory requirements - WealthBizzTradeFX Promotions are not available to users in certain restricted jurisdictions (WealthBizzTradeFX Clients with residence in the Netherlands, in Belgium and in the UK).

4. Prizes, Winner Selection and Notification

After the Promotion Period has ended, certain Participants will be selected according to the criteria set out below (“Winners”) and will be awarded a prize (“Prize”). The amount received per Prize is determined by the market value according to the asset/EUR trading pair on WealthBizzTradeFX at the time of transfer to the Winners.

Raffle:

A Participant who meets the eligibility and entry criteria (as described above) is eligible to be entered into the Promotion (“Promotion Entry”) and to win a Prize of EUR 1,000 worth of Friend3. Promotion Entries will be drawn at random until 15 (fifteen) unique Participants are selected. 15 Winners for Promotion will be awarded, each of them with a Prize of EUR 1,000 worth of Friend3.

Trading competition:

Additionally, Participants who meet the eligibility and entry criteria for the Promotion (as described above) are eligible to enter the Trading Competition (“Trading Competition Entry”). Two Participants with the highest aggregated total value of Friend3 purchased during the Promotion Period will be awarded EUR 5,000 worth of Friend3.

No substitution or cash equivalent of the Prize, or any portion thereof, is permitted. The value of crypto assets is subject to change, and there can be a substantial risk that it could lose value (potentially all value) as a result of buying, selling, or holding the Prize.

Only WealthBizzTradeFX Clients who (i) meet all the requirements described in section 3 and (ii) were not, for whatever reason, disqualified by WealthBizzTradeFX in accordance with section 5 are eligible.

WealthBizzTradeFX will strive to transfer the Prizes to the respective Participants by the end of March 2024. The transfer may be delayed and WealthBizzTradeFX shall not be liable for any losses arising out of or in connection with a late transfer (e.g. losses due to price changes).

The Prizes will be credited directly to the Participants’ respective WealthBizzTradeFX Broker wallet.

Participants, who are declared Winners in accordance with this section will be notified accordingly via email to the email address they have stated in their WealthBizzTradeFX Client Account. In the event a potential Winner cannot be contacted, fails to respond or refuses the Prize, the potential Winner will be disqualified without further notice and an alternate Winner may be selected. WealthBizzTradeFX assumes no responsibility for undeliverable emails. All potential Winners are subject to verification by WealthBizzTradeFX.

5. Disqualification

WealthBizzTradeFX reserves the right to disqualify a Participant it suspects or finds (i) to have tampered with the entry process or the operation of the Promotion, (ii) to be acting in collusion with other Participants aimed at manipulating or disrupting the Promotion, (iii) to be acting in violation of these Terms, (iv) or in breach of any other applicable terms and conditions of WealthBizzTradeFX, its subsidiaries, or (v) to have provided inaccurate information.

Disqualified Participants will not be entitled to become a Winner or win any other Prize under this Promotion.

Any attempt by a Participant to deliberately undermine the legitimate operation of this Promotion is a violation of laws, and should such an attempt be made, WealthBizzTradeFX reserves the right to seek damages from any such WealthBizzTradeFX Client or individual.

WealthBizzTradeFX is not responsible for the accuracy of the data you provide and may disqualify a participant if the email address of the WealthBizzTradeFX Client is not valid.

6. Limitation of Liability

To the extent permitted by law, in no event shall WealthBizzTradeFX be liable for any direct or indirect loss arising out of or in connection with the Promotion.

WealthBizzTradeFX reserves the right to suspend, cancel, postpone or modify the Promotion if it cannot be executed as planned for any reason. You do not have any legal claim against WealthBizzTradeFX arising out of or in connection with this Promotion.

7. Privacy and Taxes

All data processing at WealthBizzTradeFX is carried out in accordance with Article 6 Paragraph 1 Letter b of the General Data Protection Regulation 2016/679 (“GDPR”) for the purpose of establishing the legal relationship with the participant and for the subsequent implementation and processing of the Promotion.

Participants are solely responsible for any/all applicable taxes related to the Prize. Potential Winner should consult a tax advisor to determine tax implications in accepting any Prize.
